Civil Division high court upheld the decision of indefinitely suspending students found with drugs in
schools until investigations are done. This was after a student of St. Peter’s Secondary School Naalya Limited Tracy Natukunda Bamanga who was expelled from the school on being victimized of distributing cookies with cannabis known as Marijuana .
Tracy on 3 February , 2020 was admitted in senior five at St Peter’s S.S Naalya taking on Divinity , Entrepreneurship and Literature (DEL) as her combination and since first term of 2022 when she was found with cannabis and a match box , Tracy has been an undisciplined student according to the head teacher John Katongole.
She admitted guilt on being caught the first time she was found with the substance and
was given a second chance after a short break from school and she apologized.
Tracy returned to school but instead start to threaten those she suspected to have told on her .
The school could not tolerate Tracy’s behavior and decided to suspend her indefinitely for the safety of other
students . She disagreed with such a decision saying the school was quarter way the syllabus and she was missing out on quite a lot which would lead to failure of her final Examinations in November 2022
since she was in her final year in high school.
“ School management allowed Tracy Natukunda to sit for her A ‘level Examinations , but couldn’t
tolerate her to be a danger to the health and safety of other students .” said the school head teacher .
Therefore Tracy and her parents filed a case in courts of Law accusing the school of indefinitely suspending her and not allowing her to go back to study as investigations go on which the civil Division High Court Judge in Kampala Musa Sekanna ruled in the defendant’s favor ( St. Peter’s Naalya S.S
Limited. ) SPENA.
On Friday 22 September, 2023 , the Civil High Court Judge Musa Sekanna said no hearing is expected
before investigations are concluded about Students accused to posses drugs . He added on saying that it is the school’s responsibility to protect the welfare of Students and Community at large
